Welcome to the Viralby platform (“Viralby”, “we”, “our”, “us”).
By accessing or using our website, applications, or services (“Platform”), you agree to these Terms and Conditions (“Terms”) and our Privacy Policy.
If you do not agree with these Terms, please do not use the Platform.
1. Definitions
- Business Client – an individual or organization that creates a Workspace, Campaigns, Tasks, and Rewards through the Platform.
- Ambassador (Participant) – an end-user who joins campaigns, completes tasks, and receives reward points (“Points”).
- Campaign – a collection of Tasks and Benefits created by a Business Client to achieve specific marketing goals.
- Task – an assignment that a Participant must complete (e.g., posting a review, social media post, video) according to defined requirements.
- Points – the internal virtual currency of the Platform used to reward Participants for completing approved tasks.
- Benefit (Reward) – a discount, coupon, gift card, or product that Participants can redeem using their earned Points.
2. Access and Registration
2.1. You must provide accurate and up-to-date information during registration and maintain it accordingly.
2.2. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
2.3. We may suspend or terminate access to your account at any time in case of policy violations or security concerns.
3. Use of the Platform by Business Clients
3.1. Business Clients create and manage Workspaces, Campaigns, Tasks, and Benefits via the Platform interface.
3.2. Clients must ensure that all tasks and materials comply with applicable laws and third-party rights (including intellectual property and advertising regulations).
3.3. Clients are responsible for purchasing Points packages, assigning them to campaigns, and providing valid, functional reward codes or links.
3.4. Clients bear full responsibility for the authenticity, correctness, and delivery of Benefits to Participants.
4. Use of the Platform by Participants
4.1. Participants can view available campaigns, select tasks, complete them, and submit proof of completion (links or screenshots).
4.2. After verification by the Client or automated moderation system, Points are credited or the task is rejected with a comment.
4.3. Points may only be used within the Platform to redeem available Benefits. Points are not money and cannot be exchanged for cash or transferred.
4.4. Participants agree not to engage in fraudulent activity, use multiple accounts, or submit false or plagiarized content. Violations may result in permanent account suspension.
5. Rights and Obligations
5.1. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time.
5.2. Clients are responsible for ensuring that all their content and campaigns are legal, ethical, and respectful of intellectual property.
5.3. Participants are responsible for ensuring that their submitted content is authentic, original, and meets the stated task requirements.
5.4. All users agree not to use the Platform for any unlawful, fraudulent, or harmful purpose.
6. Points, Rewards, and Payments
6.1. Points are credited only after successful task approval and deducted from the Client’s campaign balance.
6.2. The value of each task and benefit is determined by the Client.
6.3. Rewards are provided to Participants via promo codes, links, or other fulfillment methods defined by the Client.
6.4. Points have no monetary value, cannot be sold, transferred, or exchanged outside of the Platform.
7. Task Verification and Moderation
7.1. Task verification may be performed manually by Clients or automatically by AI-based moderation.
7.2. Rejected tasks are considered uncompleted, and no Points are credited. Re-submission is allowed only if permitted by the campaign rules.
7.3. Participants receive notifications with comments regarding approval or rejection.
8. Liability and Limitations
8.1. The Platform is provided “as is” without any express or implied warranties. We do not guarantee uninterrupted service or specific results.
8.2. We are not liable for actions or content of Clients and Participants, nor for the legality or outcomes of any campaigns.
8.3. Clients and Participants are solely responsible for compliance with all applicable laws, including advertising, consumer protection, and copyright regulations.
8.4. We do not guarantee the perpetual availability of Points, Benefits, or campaigns. Terms may change at any time as described below.
9. Modifications to the Terms
We may revise these Terms at any time. Updates will be posted on this page or communicated via email.
Continued use of the Platform after updates constitutes your acceptance of the revised Terms.
10. Termination and Suspension
10.1. We may suspend or terminate any account that violates these Terms or acts in bad faith.
10.2. Clients or Participants may close their accounts at any time by contacting us. Upon closure, all Points, campaigns, and benefits may be voided without compensation.
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of USA.
Any disputes arising from these Terms shall be resolved in the courts of USA.
